RICS, in partnership with Link Legal as knowledge partner, has developed an arbitration service specifically for the India construction and infrastructure sector.

RICS has established a panel of qualified arbitrators to deliver arbitration services to India. The panel is made up of senior professionals from the upper echelons of the Indian property, construction, and the built environment sectors. They have been joined by several retired judges from the Supreme Court of India and various Indian High Courts and elite arbitrators from the RICS International Panel of Arbitrators. The Panel brings an unparalleled blend of local and international construction and legal expertise.

The service brings real sector-specific expertise and experience to the process. It also embraces the three primary principles of arbitration:

    i. fairness, impartiality and the avoidance of unnecessary delay or expense,

    ii. the promotion of party autonomy to resolve disputes as they see fit, and

    iii. minimising grounds for court intervention in the arbitral process.

To support the implementation of the Mediation Act 2023 RICS Dispute Resolution service was delighted to introduce the RICS Mediation Training Programme to India in May 2024 in partnership with the India International Arbitration Centre (IIAC) and Dentons Link Legal.

The Mediation Act 2023 aims to promote and facilitate mediation as a dispute resolution mechanism in India. Mediation can help parties retain control, resolves disputes quickly and removes the need for costly formal litigation.

Our Mediation Training Programme provides delegates with a comprehensive appreciation of both facilitative and evaluative mediation principles and successful completion will lead to RICS Accredited Mediator status. The face to face training is delivered over 5 full days and involves mediation role-playing.

RICS has developed a comprehensive Expert Witness Certificate which is suitable for all professionals working with the built environment who want to gain the theoretical knowledge and practical competencies required to act as an Expert Witness.

The programme is split into five competencies (mandatory attendance is required throughout):

Competency A: Managing the appointment

Competency B: Managing the post- appointment process

Competency C: Constructing a comprehensive expert report

Competency D: Discussions between experts

Competency E: Delivering effective expert evidence in court
