Overview

The Dispute Resolution Service (DRS) has developed this programme to enhance the skills and knowledge of those practising on the RICS Panel of Adjudicators. These core competencies are recognised by RICS as pre-requisites for adjudicators. This interactive, in-person programme is mandatory for all adjudicators on the RICS Panel.

Panellists must attend and successfully complete all the workshops in the five-year period since joining the Panel or since their last reassessment interview

What does the course cover?

The Appointment of the Adjudicator

At Adjudicator appointment stage and thereafter identifying & dealing with conflicts of interest when acting as a tribunal.

Dealing with jurisdictional challenges when acting as a tribunal at all stages of the adjudication process.

The Adjudication Process

Maintaining and controlling the process of an adjudication from appointment through to post decision. Addressing the management of an adjudication.

Adjudication Practice and Procedure

Contractual interpretation – such as interpretation of terms of written contracts involving ascertaining the meaning of the words, taking into consideration the context and what they would mean to a reasonable person with the relevant background and knowledge, that was available to the parties at the time the contract was formed.

Current trends will be adapted for each workshop to cover modern trends that are developing in adjudication.

The Decision

Managing evidence leading to understanding what it entails to produce a written Decision. What is expected of a party to support its pleaded case by way of evidence and then from these submissions cover how an adjudicator identifies the issues in dispute and how they then assimilates the evidence presented by the parties in support of the contested issues.

How an adjudicator goes about formulating a decision and the process followed to draft a well reasoned and enforceable decision.

Course format

The Panel Competency Programme takes shape in interactive face to face workshops. Each competency workshop will be taught over one full day (09:00 – 17:00).

The programme of workshops will focus on practical issues, which adjudicators face daily. They will be “practitioner” level and concerned with real-life problems.

Adjudicators will be encouraged to discuss issues with other participants and, where appropriate, challenge other adjudicators’ approaches to how they would deal with practical problems.

Do the workshops need to be completed in order?

Workshops 1-3 can be completed in any order but workshop 4 must be completed last and within 12 months prior to your reassessment date. The workshops will be followed with an assessment which will be incorporated into the reassessment programme.

Assessment

Upon completion of Workshop 4 (The Decision), panellists will be required to complete a written assessment. This will consist of writing of a scenario-based decision and receive feedback.

Do I need to do this as an RICS Panellist?

These competencies are mandatory and are central to ensuring that, as a Panellist, you are continuously improving your knowledge, skills and practical abilities. It will also satisfy part of your CPD requirements each year.

If you do not complete all workshops and assessments within the given five-year period, you may be failed or referred depending on the result of your assessments on individual workshops.
