What is the Homeowner Adjudication service?

Homeowner Adjudication is a specialised dispute resolution service offered by RICS for residential property disputes. This service is tailored for cases where construction work has been carried out under the JCT Building Contract for a Homeowner/Occupier. The process is designed to resolve disputes efficiently, typically within 21 days, through the appointment of an expert adjudicator by RICS.

When does Construction Act adjudication apply?

The Construction Act adjudication process does not automatically apply to residential contracts unless both parties agree. This bespoke adjudication service is not governed by the Housing Grants, Construction and Regeneration Act 1996, making it specifically suited for homeowners and builders operating under the JCT contract.

The JCT Building Contract for a Home Owner/Occupier is a standard contract designed to manage residential construction projects. It includes specific provisions that protect the interests of both the homeowner and the contractor, particularly in the event of a dispute. This contract forms the basis for the homeowner adjudication process, ensuring clarity for all parties.

RICS nominates adjudicators who are experts in the specific subject matter of the dispute from the RICS Panel of Adjudicators. Panel members must meet specific criteria to be admitted to the panel and nominated for cases. Upon receiving an application for adjudication services, RICS will select a panel member with the relevant experience and expertise in residential construction disputes, ensuring that the adjudication process is handled by a professional with the appropriate knowledge and skills.

The initial application fee for RICS Homeowner Adjudication is £120 + VAT. This fee covers the nomination of a qualified adjudicator who will deliver a decision within the 21-day timeframe, providing a cost-effective solution for resolving residential disputes. Each case is subject to further costs depending on individual circumstances.
