What is a low value adjudication?

A low value dispute refers to construction-related disputes where the sum claimed is less than £100,000 and does not involve multiple or complex issues. This category is particularly relevant for SMEs, who often face challenges in accessing affordable dispute resolution due to the high costs and legal complexities associated with some adjudication processes.

What is the difference between adjudication and arbitration?

For smaller claims, adjudication, especially through the Low Value Dispute Model Adjudication Procedure (LVD MAP), is often more efficient and cost-effective than arbitration. Where arbitration is designed for more complex cases, adjudication provides quicker resolutions, making it ideal for urgent disputes where maintaining cash flow and project momentum is crucial.

Developed in collaboration with the Construction Industry Council (CIC), the low value adjudication process is designed to be straightforward and accessible – you can visit the CIC for more information on their procedures. The adjudicator, nominated by RICS, limits the length and time for submissions, ensuring a focused review of the dispute. Both parties are required to condense their documents into no more than one A4 lever arch file. The adjudicator will review each submission and make a decision. The procedure has received the firm support of The Department for Business and Trade (DBT), formerly BEIS, and the Construction Leadership Council and is being promoted widely to industry. The timescale for resolving disputes through the low value adjudication process is typically within 28 days of the adjudicator's nomination. This expedited timeline helps SMEs resolve disputes quickly, allowing them to maintain business operations without prolonged disruptions.

To apply for the nomination of a low value dispute adjudicator, complete and return the Low Value Dispute Adjudication application form to RICS. The application fee is £425 (inclusive of VAT). Once submitted, RICS will nominate an adjudicator to handle your dispute.
