Expert determination is a procedure where parties to a dispute appoint an independent, neutral expert to determine issues in dispute. This confidential form of dispute resolution enables parties to agree a timetable with the expert who will be a person with specialist or technical knowledge relevant to the dispute.
Our online programme, will teach you how to conduct expert determination within the construction field and how to manage the process, from the initial request to act and the appointment processes, through to the production and publication of the determination.
This course is designed for individuals with a strong background and experience in construction, and who also are interested in upskilling in alternative dispute resolution.
This course is suitable for those who want to gain a better understanding of the process; those who are interested in acting as an expert determiner, as well as those who already do and wish to hone their skills.
The reduced cost and time and quick and commercially viable outcomes from expert determination is increasing the demand for this mechanism and the need for credible and skilled expert determiners.
This programme is delivered over 6 weeks and is completely online. There will be a weekly live webinar run by our experienced tutors. The online sessions will involve lectures as well as breakout room discussion exercises. See further below for the course calendar.
You will be given access to the Online Academy (OLA) where you will be able to watch the webinar recordings and download the course materials, including self-assessment questions and answers to aid your learning.
At the end of the training, you will complete an assessed assignment. This will involve drafting a valid expert determination.
Some of the advantages of independent expert determination, in particular speed, privacy and the ability to choose the decision-maker (or to have a suitable person appointed by a third party) are shared with arbitration.
Independent expert determination is now classified as a type of Alternative Dispute Resolution (‘ADR’) and is one of the types of ADR suggested by the courts to settle disputes in preference to litigation.
